GSTR-8: Return Filing, Format, Eligibility and Rules
GSTR-8 is a document or statement that needs to be filed by e-commerce operators. It is a type of return that needs to be filed every month. It contains all the details of supplies that are provided to the customers through the taxpayer’s e-commerce platform. It should also list the information related to the customer’s basic details, amount of tax deducted at source, tax payable, and tax paid.
When to file GSTR-8?
If you want to file GSTR-8 for a particular month, then you need to do that upon completion of that month. You should remember that the last day for filing this return is before the 10th of that particular month.
For example, if you are required to file the GSTR-8 for the month of April 2018, you need to file it before the 10th April, 2018.
What are the prerequisites for filing GSTR-8?
There are some requirements that needs to be fulfilled if you want to file GSTR-8:
- You need to be a registered taxpayer under the GST, having a 15-digit PAN-based GSTIN.
- The overall turnover of your business should be more than 20 lakh rupees, however, in North East, it should be 10 lakhs.
- You need to be an e-commerce operator having an online marketplace.
- All registered taxpayers who haven’t opted for the composition scheme nor have a UIN (Unique Identification Number) have to file a GSTR-8 return.
- It is not applicable to non-resident taxpayers.
- You need to have a track record of the details of the TCS (tax collected at source) for transactions that are done through your marketplace.
Why is GSTR-8 important?
GSTR-8 lists the details of all the supplies affected through e-commerce platform. It also depicts the information related to TCS collected on such supplies.
What is the penalty for not filing GSTR-8 within the due date?
You will be charged a penalty of Rs 100 under CGST and Rs 100 under SGST per day if you don’t file your GSTR-8 return on time. The total amount will be Rs 200 per day. The maximum amount will be Rs 5000. However, in the case of IGST, there is no late fee for delayed filing.
Apart from the late fees, you will be charged an interest at 18% per annum. The interest will be calculated by the taxpayer on the tax that has to be paid. The time period that will be taken into account is from the next day of filing to the date of payment.
How to revise GSTR-8?
If you file GSTR-8 once, it cannot be revised. If you make any mistake in the return, it can be revised in the next month’s return. For example, if you make any mistake in August GSTR-8, then the rectification can be done in September GSTR-8, or in later months when the error or omission is suspected.
What details need to be provided in GSTR-8?
There are some details that need to be provided in GSTR-8:
GSTIN
You need to provide GSTIN. You can also use your provisional id as GSTIN if you don’t have a GSTIN.
The Legal Name of the Registered Person
When you login into the GST portal, you will see that the name of the taxpayer will get auto-populated at that time.
Details of the supplies made through e-commerce operator
You need to mention the net value of supplies provided to both registered and unregistered people. You also need to provide details about the value of the supplies that have been returned by these registered and unregistered people. The difference between the two will give you the net amount liable for TCS.
Amendments to details of supplies with respect to any earlier statement
You need to fill in the details mentioned in the table below if you want to make any corrections in the data submitted in the previous months’ returns.
Details of interest
Interest will be levied if e-commerce operators do not pay your TCS amount on time.
Tax payable and paid
You need to mention the details related to the total number of tax payable under each head, i.e. SGST, CGST, and IGST. Also, you need to mention the amount of tax that has been paid till date.
Interest payable and paid
You need to pay the interest @ 18% for late payment of GST. The interest is calculated on the outstanding tax amount.
Refund claimed from electronic cash ledger
You can claim the refund from the electronic cash ledger only when all the TCS liability from that tax period has been settled.
Debit entries in cash ledger
Amount of TCS will flow to part C of GSTR-2A of the taxpayer on filing GSTR-8.
How to file GSTR-8 on the GST portal?
Take a look at some of the steps that are required to file GSTR-8 on GST portal:
Step-1: You need to visit the GST portal and log in by entering your credentials.
Step-2: Click on ‘Returns’ under the Services tab. Then click on ‘Returns Dashboard’
Step-3: Now you need to choose the financial year and month for which the return needs to be filed
Step-4: Then you need to click “PREPARE ONLINE” displayed below GSTR-8 in the dialogue box.
If you want to choose the offline method, you can even do that by clicking ‘Prepare Offline’
Step-5: Now you need to enter details in each box that is displayed on the dashboard. You will see the following three tiles:
Tile 3 – You need to enter the details of the TCS related to the current month.
Tile 4 – If you want to amend the details relating to the previous period, then you need to choose this option.
Tile 5 – If you want to view the details of the interest payable for delay in tax payment collected, click on this option.
1. Now you need to enter the details in tile 3 “Details of Supplies attracting TCS” & then click ‘Save’.
- GSTIN of Supplier
- The net value of supplies done and returned to such Supplier by both registered and unregistered people.
- Enter the details related to the amount collected at source under IGST/ CGST/ SGST heads.
2. In Tile 4- “Amendment to details of Supplies attracting TCS”, you need to enter accurate details against mistaken entries uploaded for any of the previous months.
Filing of amendments in the returns can be done under two instances:
- Under the option ‘Uploaded by the e-commerce operator’, rectification can be done in supplier-wise details associated with the particular month and financial year that has been mistakenly uploaded by the e-commerce operator in the previous period.
Once you click the “Amend TCS Details” option to rectify the GSTIN of the vendor, values provided against registered and unregistered vendors and TCS deducted against such supplies can be amended.
Fill in the correct details, click ‘Save’, and return back to the Amendment menu.
- Under the option ‘Rejected by supplier’, the details of transactions rejected/modified by Supplier will get displayed.
The entry appearing on the screen related to such rejection/modification can be edited. You will get the same options as in the case of “Uploaded by E-Commerce Operator” with the values recommended by the Supplier.
Once you enter the rectified data, click ‘Save’ and return back to the Amendment menu.
Step-6: Now you need to click “Preview GSTR 8” after the details have been uploaded. Thereafter, validate the uploaded data and click “Proceed to File”.
Step-7: If the GSTR-8 status is updated to “Ready to File”, it will allow tile 5 “Details of interest” and tile 6, 7 “Payment of Tax”.
Step-8: If you want to view the interest on the delayed payment of the TCS liability, the filing of the TCS return, etc., you can do that under the “Details of Interest” tile, if any.
Step-9: Once you view the ‘interest’ tile, click the “Payment of Tax” tile to enter the details of taxes paid for that particular month.
Step-10: Lastly, you can review the draft GSTR-8 and confirm the declaration for GSTR-8 filing. Then, you need to click “File GSTR 8”. Now you need to use DSC i. e. Digital Signature Certificate of the authorised signatory or EVC i.e. Electronic Verification Code.
